Because of a Like, Musk Demands Removal of Tesla Litigation Judge

Tech Sina News, Beijing Time March 26 — According to CNBC, Elon Musk’s legal team is requesting the Delaware Court of Chancery judge Kathaleen McCormick to recuse herself from two Tesla lawsuits because she liked a LinkedIn post criticizing Musk, showing bias.
In a motion filed on Wednesday, Musk’s lawyers wrote: “Given the court’s recent public support of the LinkedIn post, which has created an impression of bias against Musk in these cases, recusal is necessary and appropriate. These cases should be reassigned to another judge randomly selected by this court.”
Musk’s lawyers state that McCormick used a heart emoji response, which was hanging in the air, to show support, rather than simply liking the post. The post praised a ruling by the San Francisco federal court that could cost Musk over $2 billion. In that case, a jury found that Musk committed fraud against Twitter investors on the eve of his Twitter acquisition.

McCormick wrote to Musk’s lawyer that she had not read the full LinkedIn post in question, did not support the post, and did not intend to click any supportive emoji, possibly just accidentally touched the icon. She also stated in the letter that she had reported “suspicious activity” on her LinkedIn account.
Alex Spiro, partner at Quinn Emanuel and Musk’s attorney, told CNBC in an email that he had inquired with LinkedIn about the matter and stated, “I believe there is no basis for the ‘system malfunction’ explanation.”
McCormick previously ruled that Tesla must revoke Musk’s 2018 CEO compensation plan worth about $56 billion in options, after which she became a target of Musk’s criticism. (Author: Xiao Yu)
